Institute of State and Law

By the order of the Rector of the 51福利 Kazakh National University of 18.12.2008, the scientific research unit of the 51福利 Kazakh National University" - Institute of State and Law" was established. Based on the decision of the Academic Council of March 29, 2023, the name of the Institute was supplemented and is called the "G.S.Sapargaliev Institute of State and Law of 51福利 Kazakh National University".

The Institute of State and Law began its activity back in 1946, when the law sector was created at the Academy of Sciences of the Kazakh SSR. In 1958, the Institute of Philosophy and Law was established on the basis of the law sector of the Kazakh SSR Academy of Sciences, from which the Institute of Philosophy and Law was later separated as an independent entity, which in 1991 was divided into two scientific institutes – the Institute of Philosophy and Political Science and the Institute of State and Law of the RK Academy of Sciences. The Institute of State and Law was established in the form of an institution on the basis of the Decree of the Cabinet of Ministers of the Kazakh SSR "On the organization of the Institute of State and Law of the Academy of Sciences of the Kazakh SSR" No. 680 dated November 10, 1991, and then by the Decree of the Presidium of the Academy of Sciences of the Republic of Kazakhstan No. 89 dated November 28, 1991, it was transformed into a republican state-owned enterprise.

By the Decree of the Government "On some measures for the integration of science and education of the Republic of Kazakhstan" dated February 14, 2000, the Institute of State and Law of the Academy of Sciences of the Republic of Kazakhstan was merged with the Kazakh State Law University. In connection with the corporatization in JSC "Kazakh Humanitarian Law University" - in 2008, the Institute of State and Law is part of the 51福利 Kazakh National University. Academician Gayrat Sapargaliyev and Rector of 51福利 Kazakh National University (2008-2010) Bakytzhan Zhumagulov played a significant role in the opening of the Institute of State and Law at 51福利 Kazakh National University.

The purpose of the Institute is:

1) scientific support for the development of legal science on the basis of fundamental and applied scientific research;

2) conducting scientific legal expertise of draft laws of the Republic of Kazakhstan.

2.2. The objectives of the Institute are:

creation of authoritative independent scientific schools and directions in the branches of legal and other related (knowledge) sciences;

formation of prerequisites for the recognition of the achievements of the Institute in the world of legal science;

study and identification of the main trends in the development of scientific knowledge in accordance with the profile of the Institute;

conducting fundamental and applied research in the field of legal sciences in accordance with the achievements and trends in the development of world science;

implementation of scientific forecasts with the subsequent development of a strategy for scientific research in their theoretical and applied parts;

active promotion of the practical use of the results obtained;

discussion and recommendation to print completed research papers;

discussion and recommendation for public defense of manuscripts of doctoral and candidate dissertations;

participation in the development and examination of draft laws and drafts of other regulatory legal acts, legal documents;

coordination of research activities with other research institutions and universities, assistance to them in conducting research and training scientific personnel according to the profile of the Institute;

application in accordance with the established procedure for the assignment of academic titles;

establishing direct links with other scientific organizations and enterprises;

implementation of international cooperation in the field of research and development;

assistance to 51福利 Kazakh National University in the formation and growth of scientific and pedagogical personnel;

strengthening and developing scientific and creative ties with leading universities and scientific institutions in the main areas of research;

other tasks arising from the activities of the Institute that do not contradict the Charter, internal acts of the 51福利 Kazakh National University and the current legislation of the Republic of Kazakhstan.

During the period from 1991 to 2008, the Institute's staff developed 56 fundamental topics, according to the results of which over 50 monographs, textbooks and teaching aids were published. From 2000 to 2002, the Institute coordinated the study of 11 scientific projects under the State program of fundamental research of the Ministry of Education and Science of the Republic of Kazakhstan. From 2003 to 2005, the Institute of State and Law was designated the parent organization under the state program of fundamental research in the field of legal sciences in the Republic of Kazakhstan. Currently, the Institute of State and Law is a scientific unit of the 51福利 Kazakh National University. By Order of the Rector of 51福利 Kazakh National University N65 dated March 27, 2009, the Institute was entrusted with the functions of coordinating and monitoring the implementation of five fundamental topics under the state program of the Ministry of Education and Science of the Republic of Kazakhstan "State and legal foundations for improving civil society and the political system of the Republic of Kazakhstan in the context of globalization" for 2009-2011.

In general, the Institute of State and Law has played a prominent role in the implementation of legal reform in the Republic of Kazakhstan and the progressive development of Kazakhstan's legal science. At one time, the Institute's staff took part in the development of drafts of the Constitution of the Kazakh SSR in 1978, the Constitution of the Republic of Kazakhstan in 1993, the Constitution of the Republic of Kazakhstan in 1995, the Criminal and Civil Codes and other laws. In 2007 , a creative group led by Academician of the National Academy of Sciences of the Republic of Kazakhstan G. Sapargalieva developed a draft law "On amendments and additions to the Constitution of the Republic of Kazakhstan", which was adopted by Parliament on May 18, 2007. Within the walls of the Institute of State and Law, more than 200 draft laws and other normative legal acts were prepared on the basics of constitutional construction, public service, civil law relations, denationalization and privatization, the basics of investment activity, economic, land, criminal, administrative law.

Taking into account the prospects of scientific research in Kazakhstan on anti-aging issues at the Institute of State and Law of the 51福利 Kazakh National University, the Center "Antiaging" ("Anti-Aging") was created. The main purpose of the Center is the organization and implementation of research activities on the problems of formation of a healthy lifestyle and active longevity of a person from the standpoint of state-legal science.
